Digital Agreement Terms & Conditions

The renter accepts this contract in digital format and all clauses contained herein as if it had been executed in physical format, in accordance with Decree-Law no. 47/2018, article 9, no. 10.

The renter declares that they have received a digital version of this contract and undertakes to ensure presentation of this digital contract to the authorities whenever requested.

The rental company cannot be held responsible for failure by the renter to present this digital contract to the authorities.

Online Reservation Process

Steps to complete your online reservation at www.autorent.pt

a) Reservation Request – entering the customer’s rental details in the reservation form, namely dates, times and location.

b) Auto Rent Offer – according to the information entered by the customer, Auto Rent will present a list of all available vehicle types together with the rental value and respective terms & conditions.

c) Acceptance of Auto Rent Offer – after choosing the offer that best suits your needs, the customer will be asked to complete the reservation form with the driver’s personal details and select any optional extras.

d) Reservation Confirmation – the customer will be asked to confirm and accept the rental reservation.

e) Auto Rent Confirmation and Notification – Auto Rent will send the reservation confirmation by email, including the reference number and reservation details.

Quotation / Rental Rates

The rates presented by Auto Rent include the services and coverage expressly identified during the reservation process and in the specific reservation/rental agreement conditions.

Auto Rent offers different rate levels, which may include, among others:

  • Roadside assistance;
  • Unlimited mileage;
  • ETOLL;
  • Additional driver;
  • Additional damage coverage services.

Depending on the rate selected by the customer, different Damage Liability and security deposit amounts may apply.

This Damage Liability, indicated during the reservation process, determines the maximum amount for which the customer is liable in the event of damage to or theft of the vehicle, provided that all Rental Terms & Conditions are complied with.

The inclusions, exclusions, limitations and values applicable to each rate are defined during the reservation process, in the specific reservation/rental agreement conditions and in the applicable coverage table.

There are no hidden mandatory charges.

All quotations are presented in Euros unless otherwise stated.

Payment Methods and Security Deposit

Auto Rent does not accept American Express cards or cheques.

The following payment methods are accepted for rental payment:

  • VISA or Mastercard Credit/Debit Card in the name of the main driver;
  • Cash.

To guarantee compliance with the obligations arising from the rental agreement, a security deposit in the amount defined in the specific reservation/rental agreement conditions will be required.

The security deposit amount may vary according to:

  • vehicle category;
  • selected rate;
  • contracted coverages.

The security deposit may be provided through:

  • credit authorization (pre-authorization) on a credit card in the driver’s name; or
  • effective charge of the security deposit amount on a credit or debit card in the driver’s name.

The applicable method will depend on:

  • validation of the presented card;
  • the card issuing entity;
  • the technical possibility of performing the pre-authorization;
  • Auto Rent internal validation and security rules.

When the security deposit is provided through credit authorization, the amount will remain temporarily blocked until the end of the rental and subsequent cancellation of the authorization.

When it is not possible to perform a credit authorization, Auto Rent may proceed with the effective charge of the security deposit, which will be refunded after the end of the rental, provided that:

  • there is no damage;
  • there are no pending amounts;
  • there are no additional costs;
  • there is no contractual breach.

The time required for funds to become available after cancellation or refund depends exclusively on the card issuing bank and is outside Auto Rent’s control.

The renter authorizes Auto Rent to tokenize and securely store the presented payment method through certified payment service providers, for purposes of rental agreement guarantee and collection of amounts due under the rental agreement.

The tokenized payment method may be used to collect amounts due during or after the end of the rental, namely:

  • damages;
  • fuel;
  • tolls;
  • fines;
  • administrative fees;
  • extras;
  • extensions;
  • delays;
  • additional costs;
  • contractual breaches;
  • or any other contractually due amounts.

Auto Rent does not directly store full card details, and processing is carried out through certified payment processing entities in compliance with applicable security and data protection standards.

Other payment methods or forms of security deposit may be refused by Auto Rent.

Damage Liability and Coverage

Damage Liability is the amount for which the customer may be held liable in the event of vehicle damage/theft, provided all Rental Terms & Conditions clauses are complied with.

Applicable Damage Liability varies according to:

  • vehicle category;
  • selected rate;
  • contracted additional coverage services.

Auto Rent offers optional additional coverage services, namely:

  • RDW (Reduced Damage Waiver) — partial reduction of Damage Liability;
  • SuperCDW — elimination of Damage Liability relating to general damage and theft of the vehicle;
  • TLW — additional coverage for damage to tyres, windows and locks.

Additional coverages do not eliminate liabilities arising from:

  • negligence;
  • improper use of the vehicle;
  • driving under the influence of alcohol or drugs;
  • use outside the contractually agreed conditions;
  • loss or damage to keys;
  • incorrect refuelling;
  • interior vehicle damage;
  • damage resulting from breach of the Terms & Conditions.

The applicable Damage Liability, security deposit and coverages are defined in the specific reservation/rental agreement conditions and in the applicable coverage table.

Damage to tyres, windows and locks is not covered by CDW, RDW and SuperCDW coverage, being covered exclusively by TLW.

The Damage Liability amount is described in the specific reservation/rental agreement conditions.

The value of RDW, SuperCDW and/or TLW coverage services is defined in the specific reservation/rental agreement conditions.

Third-party liability insurance: €50,000,000.

Commercial Coverages

Auto Rent offers different commercial coverage levels, namely:

  • Care;
  • Plus;
  • Relax.

Each coverage level may include different services for reducing or eliminating Damage Liability, as well as different security deposit amounts.

Coverage Exclusions

Regardless of the selected rate or coverage, the following remain excluded:

  • incorrect refuelling;
  • loss, damage or misplacement of keys;
  • damage caused by negligence;
  • damage caused by driving under the influence of alcohol or drugs;
  • damage caused by improper use of the vehicle;
  • damage caused by breach of these Terms & Conditions;
  • damage caused to the interior of the vehicle;
  • fines, tolls or administrative costs.

Fuel Policy

The vehicle must be returned at the end of the rental with the same amount of fuel as at the beginning. Additional charges will apply in case of non-compliance according to the General Rental Terms & Conditions:

Tolls / ETOLL

According to Decree-Law 84-C/2022, all rental vehicles are equipped with an Electronic Toll Collection Device (DECP), and the customer is responsible for all tolls during the Rental Agreement period, payment being made exclusively to the rental company.

For management of this service, the rental company charges an extra called ETOLL Service (price specified in the specific conditions; toll values not included).

Toll payment is due by the customer at the end of the rental and after that date whenever requested by the rental company (depending on toll information made available by concessionaires, which may take up to 120 days). The renter must keep the indicated payment method active and with sufficient funds for collection.

If collection through the payment method indicated at the beginning of the rental is not possible, the rental company is obliged to communicate the renter’s personal data to the concessionaire, exempting itself from any further responsibility

Geographical Restrictions

Vehicles may only be taken to Spain, subject to the respective fee indicated in the specific reservation/rental agreement conditions. Authorization may be requested during reservation or at the counter.

Driver

Age

Drivers must be between 26 and 99 years old.

Drivers aged between 21 and 25 are subject to additional charges.

Drivers who do not comply with the age limits cannot rent a vehicle.

Driving Licence

A valid original driving licence issued more than 1 year ago by a European Union country or by states adhering to the International Road Traffic Conventions (Geneva 1949 and Vienna 1968), as well as Andorra, Angola, Brazil, United Arab Emirates, Morocco, Mozambique, São Tomé and Príncipe or Switzerland, is required.

Identification Documents

The driver may be identified through Passport or Identification Card issued by European Union member states.

Failure to present the original documents mentioned above makes the rental impossible.

Vehicle Pick-Up (Faro Airport)

You should proceed to Car Park 4 (P4) at Faro Airport for the free shuttle service to Auto Rent facilities (5 min).

If the customer does not appear to collect the vehicle within 2 hours after the scheduled reservation time, the reservation will be considered a No Show and the vehicle will become available.

Vehicle Return (Faro Airport)

Vehicle return at Auto Rent facilities as shown in the image below, including complimentary transfer back to the airport. Please allow enough time for vehicle inspection upon return.

The customer is responsible for the vehicle until the return process is completed.

The customer must not leave the vehicle anywhere other than Auto Rent facilities, otherwise they will be in breach of the rental agreement and subject to all related charges.

Any delay of 2 or more hours after the scheduled return time will result in an extra rental day charge.

Out of Hours Pick-Up or Return (Faro Airport)

All rentals with pick-up or return outside business hours (between 20:00 and 08:00) are subject to an Out of Hours Fee.

Vehicle Pick-Up and Return (Praia da Rocha)

Vehicle pick-up takes place at Auto Rent facilities located at Avenida Tomás Cabreira, Edifício Vistamar, Loja I, 8500-802 Portimão, where the rental agreement will be signed.

If the customer does not appear to collect the vehicle within 2 hours after the scheduled reservation time, the reservation will be considered a No Show and the vehicle will become available.

The customer must return the vehicle to the same facilities. Please allow enough time for vehicle inspection upon return.

The customer is responsible for the vehicle until the return process is completed.

The customer must not leave the vehicle anywhere other than Auto Rent facilities, otherwise they will be in breach of the rental agreement and subject to all related charges.

Any delay of 2 or more hours after the scheduled return time will result in an extra rental day charge.

Vehicle delivery and return at accommodation is possible upon prior request (minimum 24 hours), subject to availability, associated costs and only available in the following areas: Portimão, Alvor, Ferragudo, Parchal and Carvoeiro.

Vehicle returns at Praia da Rocha facilities after 13:00 must be carried out as follows: the customer must park the vehicle in the designated spaces (Auto Rent Reserved Parking) at Rua Eng. Francisco Bivar ( https://maps.app.goo.gl/S1nvSHd9P35mkXfQ9) and return the key at the Auto Rent store on Av. Tomás Cabreira.

GENERAL VEHICLE RENTAL TERMS & CONDITIONS

1 – PURPOSE

Auto Rent – Automóveis de Aluguer, Lda., hereinafter referred to as the rental company, rents the motor vehicle identified in the specific rental agreement conditions (hereinafter simply referred to as the Agreement) to the customer identified in the first clause of the specific conditions, hereinafter referred to as the renter, under the following general terms and conditions.

2 – VEHICLE DELIVERY AND RETURN

1 The renter declares that they received the vehicle in proper operating and cleaning condition, together with the respective accessories and documents mentioned in the Agreement and in the joint inspection document called “Vehicle Check Sheet”, undertaking to return it in the same condition in which it was received, at the location and date specified in the Agreement.

2 Fuel Policy: The vehicle must be returned with the same fuel level as delivered, as indicated in this Agreement and in the “check-out/check-in” inspection report.

3 If the vehicle is returned with a lower fuel level, the following charges will apply:

a) Groups A, C1, E, F, J1, J2, 0: € 15 (VAT incl.) per each 1/8 fuel difference;

b) Groups H1, L1, 1, 2: € 30 (VAT incl.) per each 1/8 fuel difference.

4 No fuel refund will be granted if the vehicle is returned with a higher fuel level than initially delivered.

5 If the vehicle is used in breach of the Agreement, the rental company may terminate the Agreement, and the renter shall be obliged to return the vehicle to the indicated location, failing which the vehicle may be repossessed under the law at the renter’s expense.

6 If the renter wishes to extend the rental period, they must go to the rental company facilities to sign a new agreement, subject to approval, at least 24 hours before the end of the current Agreement.

7 The rental company shall not be liable to the renter or any passenger for loss of or damage to personal belongings left in the vehicle during or after the rental period.

3 – USE OF THE VEHICLE

The renter shall take proper care of the vehicle, ensuring that it is properly locked and parked in a safe place whenever not in use, refuelled with the correct fuel and that any security device installed in the vehicle is properly activated and used diligently.

The renter undertakes not to use or allow the vehicle to be used in the following situations:

a) For transportation of passengers or goods in violation of the law;

b) For sports events or training sessions, official or otherwise;

c) By any person under the influence of alcohol, drugs or any other substance which directly or indirectly affects perception and reaction ability;

d) By persons holding a driving licence for less than one year and by persons who are not authorised drivers, i.e. not identified in the Agreement or attached documents;

e) Outside Portuguese territory, unless expressly authorised by the rental company;

f) For placement of advertising, political or commercial references or similar without prior written authorisation from the rental company;

g) For transportation of passengers or goods in paid service, sub-rental, lending or transfer without prior express authorisation from the rental company.

4 – VEHICLE MAINTENANCE AND REPAIR

In the event of vehicle breakdown, repairs may only be carried out with prior approval from the rental company.

5 – SERVICES

The renter may contract the following services:

a) CDW – Covers all damage caused to the vehicle in the event of accident, theft or robbery, with the renter remaining liable for a “Damage Liability” amount varying according to the vehicle type, available at the counters and described in the specific Agreement conditions;

b) RDW – Partial Damage Liability reduction service, commercially designated as Care, which reduces the maximum amount for which the renter may be liable in the event of vehicle damage, theft or robbery, under the terms and values defined in the specific Agreement conditions;

c) SuperCDW – Service for elimination or reduction of Damage Liability relating to general vehicle damage, theft or robbery, commercially integrated into the Plus or Relax coverages, without prejudice to the exclusions provided in these Terms & Conditions;

d) TLW – Additional coverage service for damage to tyres, windows and locks, commercially integrated into the Relax coverage, under the terms defined in the specific Agreement conditions;

e) PAI – Personal Accident Insurance for the driver, with maximum coverage amounts of €1,500.00 (one thousand five hundred euros) in case of illness or hospitalization and €15,000.00 (fifteen thousand euros) in case of death or disability.

In the event of accident, the renter undertakes to:

a) Immediately report any accident, theft, robbery or other incident to the rental company and police authorities;

b) Obtain names and addresses of involved persons and witnesses, as well as insurance details of third-party vehicles;

c) Not abandon the vehicle without taking appropriate measures to protect and safeguard it;

d) Not assume responsibility or plead guilty in case of accident;

e) Immediately contact the rental company and provide a detailed accident report, including police reports and details of third parties and witnesses involved.

Only the renter and/or authorised drivers may benefit from SuperCDW, RDW, CDW, PAI and TLW coverages.

Even if the renter subscribes to SuperCDW, RDW, CDW, PAI and TLW coverages, all damages arising from misuse of the vehicle or breach of these Terms & Conditions remain the renter’s sole responsibility.

In the event of accident or damage caused to the vehicle due to speeding, negligence, driving under the influence of alcohol, narcotics or any product that reduces driving ability, and in breach of paragraph 2 of this clause, the renter shall be liable for all repair costs and compensation corresponding to the immobilisation period of the damaged vehicle, even if SuperCDW and/or CDW and/or RDW coverage has been contracted.

The vehicle shall only benefit from CDW, RDW and/or n coverage during the rental period agreed in the Agreement, unless the Agreement is extended under these general conditions. The rental company declines all responsibility for accidents caused by the renter beyond the rental period, the renter being solely and exclusively responsible for them.

6 – PAYMENTS

The renter expressly undertakes to pay all amounts due arising from this Agreement to the rental company upon request, namely:

a) The rental price of the vehicle according to the rental period and mileage calculated according to the rates stated in the Agreement;

b) Any and all charges relating to services described in clause 5 and any other applicable expenses in accordance with the rates or fees stated in the specific conditions of this Agreement;

c) All taxes and charges applicable to the rental or the amount set by the rental company for reimbursement of such taxes;

d) All costs incurred by the rental company arising from collection of outstanding payments due by the renter under this Agreement;

e) All toll charges associated with circulation of the rented vehicle during the rental period.

Any invoice not paid on its due date shall accrue late payment interest at the maximum rate legally permitted.

In case of accident for which the renter is responsible, the renter shall pay €100.00 (one hundred euros) plus VAT at the legal rate in force as administrative expenses relating to the respective process.

To guarantee compliance with obligations arising from the Agreement, the renter shall provide a security deposit in the amount defined in the specific Agreement conditions.

The security deposit may be provided through credit card pre-authorisation in the name of the main driver or, where not possible, through effective charge of the security deposit amount on a credit or debit card in the name of the main driver.

The renter expressly authorises the rental company to use the security deposit and/or the indicated payment method to collect amounts due under the Agreement, including damages, fuel, tolls, fines, administrative fees, extras, delays, additional costs or any other contractually due amounts.

Where the security deposit is provided through pre-authorisation, cancellation will be processed after the end of the rental, provided no outstanding amounts exist. Where the security deposit is effectively charged, refund shall be processed after the end of the rental, deducting any amounts due by the renter where applicable.

The availability period of refunded amounts depends exclusively on the card issuing bank.

7- ADMINISTRATIVE EXPENSES

If the rental company is notified due to offences or unlawful conduct committed by the renter solely for identification purposes, the renter undertakes to pay €25.00 (twenty-five euros) plus VAT at the legal rate in force as administrative expenses for the information provided to those entities during and after the rental period.

8 – AGREED DOMICILE

The parties agree that the addresses stated in the Agreement shall be considered valid for any communication purposes, namely service of notices or legal notifications.

This Agreement is governed by Portuguese Law, and the Court of Portimão shall have exclusive jurisdiction over any disputes arising from it.

9 – INFORMATION AND CLARIFICATIONS

The renter acknowledges that all clauses contained in this Agreement were communicated and explained in due time and that they fully understand and accept them, therefore signing this Agreement.

10 – POERSONAL DATA

Auto Rent – Automóveis de Aluguer, Lda., VAT no. 501618600, headquartered at Avenida Tomás Cabreira, Edifício Vistamar, Loja I, 8500-802 Portimão (Portugal), email: dp@autorent.pt and telephone +351 282 417 171, as data controller, shall process the personal data contained in this document for the following purposes:

a) Invoicing;

b) Customer Management;

c) Payment and Debt Collection Management.

Provision of personal data is mandatory for execution of the Agreement.

Auto Rent may transmit personal data to:

a) Insurance companies and assistance providers;

b) Toll concessionaires and electronic toll entities;

c) Tax Authorities;

d) Communication, marketing and advertising service providers;

e) Legal service providers;

f) Police and judicial authorities;

g) Electronic payment and payment tokenization service providers;

h) Travel agents/tour operators/commercial intermediaries involved in the contractual relationship.

Personal data shall be retained:

a) For invoicing purposes, for 10 years;

b) For payment and debt collection purposes, until settlement of outstanding amounts or final judicial decision.

Personal data shall be stored on servers/databases located within the European Union.

As data subject, the renter may request access, rectification, erasure, restriction, opposition or portability of personal data through dp@autorent.pt.

Auto Rent shall never sell or transfer customers’ personal data to third parties for marketing or commercialisation purposes.

The renter authorises communication of personal data to ARAC (Portuguese Car Rental Association) for database inclusion in case of contractual breaches.

The renter acknowledges that the vehicle is equipped with a GPS geolocation device which may be used in case of contractual breach.
